General Terms of Service

By commissioning InLoc Design, you hereby agree to the following Terms of Service

SCOPE OF WORKS

  • The Design Package outlines the typical deliverables, exclusions and basic terms for each item. Please refer to the package description for a detailed breakdown

FEES

  • A deposit is required at the time of booking, payable through this website;
  • The remaining balance (including any variations) is payable once the final drawings have been completed and are ready to be handed over to you

EXCLUSIONS

  • Unless noted and agreed to in writing, InLoc Design will not engage any third party consultants / contractors for this project. You are responsible for the engagement and payment of any third parties that may be deemed necessary for the scope of works.  This may include, but not be limited to, engineers, certifiers, local government agencies, inspectors, lessors/lessees etc;
  • We will work with any of third party you so choose to engage to the best of our ability and timeliness as part of the reasonable demands for design development and documentation.  Excessive time or notice will be negotiated in good faith by all parties;
 
CONTACT HOURS
  • Studio hours are Monday to Friday 10am to 5pm.  Please be aware that we are working on consecutive projects so may not always be responsive immediately.  We will endeavour to be available at the earliest opportunity.

GENERAL TERMS

  •  Whilst all good faith is made with site and material dimensions, contractors and consultants shall verify actual site conditions prior to preparing shop drawings or works, and shall advise of any discrepancies that may affect the finished design intent, compliance or functionality;
  • Where site drawings, dimensions and photos have been supplied by the Client, we accept no responsibility for the accuracy of any information or resultant issues that may arise from such;
  • The Client shall indemnify InLoc Design against claims where the Client or its agents/consultants/contractors have substituted construction methods, materials or designs that are detrimental to the finished product.  With that in mind, we are always eager to be advised where a safer, cost effective or more desirable outcome can be achieved in manufacturing or construction processes;
  • The Client shall be responsible for ensuring their contractors/consultants are working off the latest drawings.  We will provide drawings to the Client only, unless we agree to otherwise in writing
  • Finished drawing deliverables will be provided in PDF format, either through email or via download services of our choosing.

CANCELLATION

  • Either party may cancel these services by written notice.  The CLient shall be liable for any monies due up to the next design stage based on the level of work and/or service provided at that time.  Both parties shall do so in good faith;
  • Both parties will go their separate ways without liability once all oayments and deliverables have been transferred to the other

PROMOTION

  • InLoc Design, or our agents, shall have access to the site throughout the project and for up to 6 months after completion for the purposes of photography, media and other promotional activities.  Such access will be mutually agreed so as to cause minimal disruption to the project operations.

COPYRIGHT & OWNERSHIP

  • Copyright remains with InLoc Design in respect of all design concepts, renderings, samples, drawings and schedules. No part shall be reproduced or constructed without written permission;
  • Permission is given to the Client to construct the works as they relate to the design package they have commissioned, for use at a single site, unless otherwise agreed to in writing. Additional fees will be liable for additional sites where our design and schedules have been integrated

FEES

  • A deposit is required at the time of booking, payable through this website;
  • The remaining balance (including any variations) is payable prior to the transfer of the site to the Client
  • where we have paid for additional services (see exclusions) as agreed, those fees shall also be reimbursed in full by the Client prior to handover of the site

EXCLUSIONS

  • Unless noted and agreed to in writing, InLoc Design will not source or provide any third party products or services that are not part of the original brief requirements. This shall include, but not be limited to, web hosting, email hosting, marketing campaigns, domain names, etc

TRAINING

  • Training shall be provided to the Client (or their employee) to a suitable level based on the complexity of the website being commissioned. This shall be in a form of our choosing, but is typically a PDF document and/or recorded instructional videos.

  • Either party may cancel these services by written notice.  The Client shall be liable for any monies due up to the next design stage based on the level of work and/or service provided at that time.  Both parties shall do so in good faith;
  • Both parties will go their separate ways without liability once all payments and deliverables have been transferred to the other

PROMOTION

  • InLoc Design, or our agents, shall have the right to promote the works through our portfolio, branding, or other marketing activities

COPYRIGHT & OWNERSHIP

  • Copyright remains with InLoc Design in respect of all designs, code and images where we were the developer of same;
  • Copyright remains with third party developers for any plugins, software-as-a-solution (SAAS), or other components or scripts that may be utilised in the website

SITE MAINTENANCE AND BACK-UPS

  • The onus is with the Client to provide adequate back-ups of all data, personal information, payments once the site has been handed over to them by us;
  • Ongoing site maintenance, including updates of any systems, codes, plugins or scripts that have been utilised in the creation of the website will remain the responsibility of the Client, unless otherwise agreed to in writing, or unless it is part of a Website Maintenance Package that has been commissioned and paid to us
